In 1995, the Texas Legislature created the Public Education Grant (PEG) program [TEC §§29.201 - 29.205]. The PEG program permits parents whose children attend schools on the PEG list to request that their children transfer to schools in other districts. A list of PEG-designated schools is provided to districts annually. By February 1, districts must notify each parent of a student in the district assigned to attend a school on the PEG list. Based on the February list, parents may request a transfer for the following school year. (For example, the list provided to parents by February 1, 2012 allows for transfer requests for the 2012-13 school year.)
Districts are instructed to provide a clear, concise explanation of PEG when they notify parents. Each school’s situation for being on the PEG list is unique, and so each school must write its own letter, addressing its specific situation. In writing this letter, it is recommended that local administrators:
  • state the basic situation (that the school is on the PEG list for the 2012-13 school year);
  • describe what the PEG program is
  • explain how the school came to be on the list;
  • address how the school plans to remedy any problems; and,
  • state the district’s policy regarding transfers.
Schools are included on the list if: 

  1. 50 percent or fewer of the students passed: 
  • 2010 and 2011: any reading/English language arts, writing, mathematics, science, or social studies test on the Texas Assessment of Knowledge and Skills (TAKS), summed across the grades tested at the school 
  • 2012: any reading or mathematics test on the State of Texas Assessments of Academic Readiness (STAAR) in grades 3-8 at the TAKS-equivalency standard, or any English language arts or mathematics test on the TAKS in grades 10 and 11, summed across the grades tested at the school in any two of the three years:  2010, 2011, or 2012

  1. the school was rated Academically Unacceptable in 2010 or 2011.
[No state accountability ratings were issued in the 2011-12 school year.] 

  • Certain schools are excluded from PEG identification. Types of schools excluded are:
  • Alternative education campuses that are rated under Alternative Education Accountability (AEA) rating procedures; 
  • Campuses identified as alternative instructional campus types; 
  • Disciplinary Alternative Education Programs (DAEPs); 
  • Juvenile Justice Alternative Education Programs (JJAEPs); 
  • Charter schools; 
  • Schools with no students tested or fewer than five students tested on TAKS/STAAR (inall three years examined). 
The TAKS/STAAR results are based on campus mobility rules; that is, only students who 
were enrolled in the campus in late October are included. 
  • For school years 2009-10 and 2010-11, the TAKS results for each year use the grades, subjects, and tests evaluated for state accountability that year.  In 2012, the STAAR indicator includes the performance on STAAR Modified and STAAR Alternate for grades 3-8 reading and mathematics. The TAKS indicator includes the performance on TAKSModified (TAKS-M) for grades 10 and 11 English language arts and mathematics.
  • The 2012 STAAR results for grades 3 – 8 are evaluated based on the TAKS-equivalency standard that was developed using the bridge study that is posted online at 

  • In 2011 two new base indicators—Commended Performance and the English Language Learners (ELL) Progress Indicator—were added to the accountability system. These indicators could prevent a campus or district from earning a Recognized or Exemplary rating, but could not be the cause of an Academically Unacceptable rating. 

What Does This Mean?
As the parent or guardian of a student attending a campus identified for school improvement status, you have the option to request a transfer of your child to a campus in another school district for the 2012-2013 school year. If you apply for transfer to a neighboring school district, the district chosen is entitled to accept or reject the application for the student to attend school in that district but may not use criteria that discriminate on the basis of a student’s race, ethnicity, academic achievement, athletic abilities, language proficiency, sex, or socioeconomic status. If the application is accepted, the school district chosen may not charge the student tuition. The home school district does not have to pay for transportation charges to and from the school.

How Long Is My Child Eligible for the Transfer?
IT IS IMPORTANT TO NOTE that student eligibility for transfer expires upon any of the following three conditions:
  • Completion of all grades on the campus upon which eligibility was originally based (6-8);
  • Removal of the campus from the PEG list;
  • Assignment of the student to a campus that is not on the PEG list as a result of redrawn attendance boundaries.

Transfers Within the District and the Desegregation Order
The state law requiring districts to offer transfers within the district conflicts with a court-imposed desegregation order to which the District is currently subject. The desegregation order prohibits intra-district transfers except in cases involving “majority-to-minority” transfers. A very limited number of transfers to another campus within Longview ISD may be possible if your student falls into the “majority to minority” exception. In the event the court modifies the District’s desegregation order to allow the PEG transfer requests, you will be advised by the District of the transfer options available to you at that time.
Under the PEG program, a student can continue to be eligible for transfer until he/she completes all grades at the campus to which the transfer was approved. The student would then return to his or her home district.
